This Data Processing Agreement ("DPA") forms part of the agreement between you ("Controller") and Fieldware Group Ltd ("Processor") for the provision of the CircuitCapture service.

1. Definitions

  • Controller: you, the CircuitCapture subscriber, who determines the purposes and means of processing personal data
  • Processor: Fieldware Group Ltd, who processes personal data on your behalf
  • Personal data: any information relating to an identified or identifiable natural person (including customer names and addresses in job briefs)

2. Subject matter and nature of processing

CircuitCapture processes personal data you provide (including customer names and property addresses contained in voice notes) for the purpose of generating job briefs and estimates.

3. Your obligations as Controller

You are responsible for ensuring you have a lawful basis for collecting and processing customer personal data, and for obtaining any necessary consents before including customer details in voice notes sent to CircuitCapture.

4. Our obligations as Processor

We will:

  • Process personal data only on your documented instructions
  • Ensure appropriate technical and organisational measures are in place
  • Not engage sub-processors without your prior authorisation
  • Assist you in responding to data subject rights requests
  • Delete or return all personal data on termination of the service
  • Notify you without undue delay of any personal data breach

5. Sub-processors

CircuitCapture uses a limited number of sub-processors (such as cloud hosting and AI processing services) to deliver the service. A current list of sub-processors is available on request at info@circuitcapture.com.

6. Data transfers

Where personal data is transferred outside the UK, we ensure appropriate safeguards are in place in accordance with UK GDPR requirements.

7. Governing law

This DPA is governed by the laws of England and Wales.
